2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 272, 273/34 of the Indian Penal Code, Section 78 of the Juvenile Justice Act and Sections 30(a), 44 of Bihar Prohibition and Excise Act.

3. As per prosecution case, 69.9 liters of Nepali country made liquor was recovered from motorcycle.

4. Learned counsel for the petitioner submits that no incriminating material has been recovered from the conscious possession of the petitioner. Petitioner is neither driver nor owner of the motorcycle in question and he has been made accused in this case only on suspicion.

5. Learned A.P.P. for the State opposes the prayer for bail and submits that the petitioner has got two criminal
