The petitioners apprehend their arrest in Buxar Nagar P.S. Case No.750 of 2018 registered under Sections 366(A) and 120B of the Indian Penal Code.

The mother of the victim disclosed that she did not find her daughter in her house at about 10-11 P.M. in the night on 19.12.2018. During the course of search, Paras Ram, his wife(Meena Devi), Mukesh Ram and Gorakh Ram(brothers of Durgesh Ram) disclosed that Durgesh Ram kidnapped her daughter.

The learned counsel for the petitioners submits that

Patna High Court CR. MISC. No.37017 of 2019(2) dt.17-06-2019 2/2 daughter of the informant was sleeping in her house. She left her house and fled away with Durgesh Ram. Both solemnised marriage out of their free will. The victim made her statement under Section 164 Cr.P.C. and she disclosed her age about 18 years. Durgesh Ram has already been granted anticipatory bail after considering the statement of the victim recorded under Section 164 Cr.P.C. vide order dated 09.05.2019 passed in Cr. Misc. No.30631 of 2019. The petitioners are parents and brothers of Durgesh Ram.

Taking into consideration the facts aforesaid, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar in connection with Buxar Nagar P.S. Case No.750 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
