Petitioner seeks bail in Bihariganj P.S. Case No.303 of 2018 instituted for the offence under Section(s) 394 Indian Penal Code.
Counsel for the petitioner submits that petitioner is not named in the First Information Report. No Test Identification Parade has been held. It is mentioned in the impugned order that in the case diary it has come that petitioner was apprehended in Bihariganj P.S. Case No.306 of 2018 in which he was found in possession of owner book of bike of the informant alleged to have been stolen in this case and one loaded pistol with live cartridges. Thereafter, petitioner has been remanded in this case.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st class, Udakishunganj, Madhepura, in connection with Bihariganj P.S.
