JUSTICE SUDHIR SINGH ORAL ORDER 29-09-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 399 and 402 of the Indian Penal Code and Section 25(1-b)a, 26 an d 35 of the Arms Act. It is alleged by the informant that some miscreants armed with katta were preparing the plan to commit serious crime. On such information the informant along with police personnel the miscreants tried to flee away but on chase four miscreants were apprehended by the police and rest miscreants fleeing away taking the advantage of darkness.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. Petitioner's name has appeared on the basis of confession of a co-accused. The

Patna High Court Cr.Misc. No.28203 of 2015 (3) dt.29-09-2015 other co-accused has already been granted anticipatory bail by this Court vide Cr.Misc.No.37746 of 2015.

On behalf of the State, it has been submitted that the petitioner is named in the FIR.

Considering the aforesaid facts, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Vaishali at Hajipur in connection with Bidupur P.S.Case No.379 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
