Petitioner seeks bail in Muzaffarpur Rail P.S. Case No.45 of 2019 instituted for the offence under Section(s) 379, 356, 411 and 414 Indian Penal Code.

Counsel for the petitioner submits that petitioner is not named in the First Information Report. No incriminating article has been recovered from his possession. The alleged stolen article has been recovered from possession of co-accused Ranjit Kumar, who took the name of one Parduman Kumar, stating that he has purchased the aforesaid mobile from him. Name of the petitioner has come during investigation in the confessional statement of Praduman Kumar.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Rail, Sonepur, Saran, in connection with Muzaffarpur Rail P.S. Case No.45 of 2019, subject to the condition that both the bailors shall be close relative of the petitioner.
