The Petitioner seeks bail in Kadwa P.S. Case No.321 of 2016 instituted for the offence under Section(s) 272, 273 Indian Penal Code and Section 30(a), 37(a) of Bihar Prohibition & Excise Amendment Act, 2016.
As per written report, foreign liquor was recovered from Scorpio Car. Two persons fled away from the vehicle and one person was caught, who disclosed his name as Sanoj. It is alleged that, in the meantime, this petitioner came on motorcycle and he was arrested on suspicion. The police made search of this petitioner and as per seizure list (Annexure-1/A), nothing incriminating was recovered except his mobile phone. It is submitted that the petitioner is in custody since

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the Petitioner, above named, be released on bail on furnishing bail bond of `10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the 2nd Additional Sessions Judge-cumSpecial Judge, Katihar, in connection with Kadwa P.S.
