The petitioner seeks regular bail in connection with Inarwa P.S. Case No. 46 of 2022 registered for the offence under Sections 366A/34 of the Indian Penal Code and Section 8 of the Protection of Children From Sexual Offence Act. Allegation against the petitioner is of abduction of minor daughter of the informant.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case only on the basis of mere suspicion. A statement has been made in para 3 of the petition that the petitioner got no criminal antecedent. It is further submitted that the victim girl recovered and stated in her

Patna High Court CR. MISC. No.41163 of 2022(4) dt.04-01-2023 2/2 statement recorded under section 164 of Cr.P.C. that she herself left her house and also did not whisper the complicity of the petitioner. The petitioner is languishing in judicial custody since 31.5.2022.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Inarwa P.S. Case No. 46 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District JudgeVIIth-cum-Special Judge, POCSO Act, West Champaran at Bettiah.
