1. Heard learned counsel for the petitioner and learned APP for the State.
2. The petitioner apprehends his arrest in connection with Madhaurah P.S. Case No. 554 of 2022 registered for the offences punishable under Sections 341, 323, 324, 307, 504 and 34 of the Indian Penal Code.
3. The learned APP for the State submits that it appears that by order dated 28.07.2023, the injury report of the informant along with a copy of the case diary was called for, the case diary has been received but the injury report, till date, has not been received. The learned APP next submits that from perusal of the allegation as alleged in the FIR, it would manifest that the informant alleges that the petitioner assaulted the
Patna High Court CR. MISC. No.41140 of 2023(4) dt.20-02-2024 2/2 injured by Dab on his head causing injury. It is next submitted that the injury suffered by the injured is on vital part of the body.
4. On query of the Court from learned counsel for the petitioner with regard to the injury suffered by the injured, it has been fairly submitted that the injury is grievous.
5. Considering the submission made by the learned APP and the fact that the injured has suffered grievous injury, the Court is not inclined to entertain the anticipatory bail application.
6. Accordingly, the present anticipatory bail application stands rejected.
