2. The petitioner seeks bail in connection with Deepnagar P.S. Case No. 259 of 2023 registered for the offence punishable under Sections 147, 148, 149, 342, 302, 504 and 506 of the Indian Penal Code.

3. The petitioner and other accused persons are said to have killed the deceased.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. Learned counsel further submits that there exist a deep rooted civil dispute relating to partition of ancestral property between the family of the informant and the family of the

Patna High Court CR. MISC. No.39611 of 2026(2) dt.22-06-2026 2/3 petitioner who are both related (Gotiyas). The petitioner is in custody since 21.12.2025.

5. Learned APP appearing for the State and learned counsel for the informant have opposed the prayer for regular bail of the petitioner.

6. Though the petitioner is named in the FIR but there is no overt act against him.

7. Considering the fact that the main allegation is not levelled against the petitioner, this application is allowed.

8. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Incharge CJM, Biharsharif, Nalanda/ concerned Court below in connection with Deepnagar P.S. Case No. 259 of 2023.

9. After being released on bail, the petitioner is directed to cooperate in the trial by appearing personally till the framing of charge and after framing of charge he is directed to cooperate in the trial either by appearing personally or through his lawyer. Non-compliance of the condition will result in cancellation of the bail bonds of the petitioner.

10. It is, however, clarified that the observations made
