The petitioner has prayed for bail in connection with Shivsagar P.S. Case No. 158 of 2019 registered for the offence under Sections 30(a) and 41 of Bihar Prohibition and Excise Act, 2016.

As per the allegation in the FIR, during the course of checking of vehicle by the police, 227.865 liters of illicit liquor was recovered from the Bolero car and three persons, sitting in the vehicle, attempted to escape, but one of them was caught. It is submitted by the learned counsel for the petitioner that nothing has been recovered from conscious possession of the petitioner. He has no concern either with the alleged vehicle or with the seized liquor. Petitioner had merely

Having heard the learned counsel for the parties and considering the fact that petitioner has got no criminal antecedent, this Court is inclined to grant bail to the petitioner. The above named petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge-IInd-cum-Special Judge, Excise, Rohtas at Sasaram in connection with Shivsagar P.S. Case No. 158 of 2019.
