In the present case, the petitioner is seeking bail in connection with Excise Case No. 1100/019 arising out of Kaler P.S. Case No.68 of 2019 registered for offences punishable under Section 30 (a) of Bihar Prohibition and Excise Act, 2018.
Counsel for the petitioner submits that earlier the petitioner had filed a Cr. Misc. No. 616 of 2020 for grant of bail, which was rejected by this Court vide order dated 09.07.2020 with a liberty to renew his prayer for bail after completion of one year of his judicial custody and now the petitioner has completed more than one year of his judicial
Patna High Court CR. MISC. No.37316 of 2020(2) dt.05-01-2021 2/2 custody as he is in judicial custody since 6.10.2019. Considering the period of custody, the petitioner, above-named, is directed to be released on bail on furnishing bail bonds of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-II-cum-Special Judge, Excise Act, Jehanabad in connection with Excise Case No. 1100/019 arising out of Kaler P.S. Case No. 68 of 2019 with a condition that if the petitioner, after his release in this case, is again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of his bail bonds with further condition that one of the bailor will be the close relative of the petitioner.
