JUSTICE BIRENDRA KUMAR ORAL ORDER 20-06-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Section 395 of the Indian Penal Code and Sections 25(1-B)a/27 of the Arms Act.

The F.I.R. of the offence of dacoity is against unknown. Name of the petitioner had surfaced in the confessional statement of co-accused. The petitioner is in custody since 25.12.2016, however, he has not been put on Test Identification Parade during investigation nor anything has been recovered from his possession. The investigation is already complete now against the petitioner.

No.21404 of 2017 (3) dt.20-06-2017 2/2 Considering the facts and circumstances, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.20,000/-(Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur/Successor Court, in connection with Kotwali (Tilak Manjhi) P.S. Case No.588 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
