The petitioner apprehends his arrest in a case registered for the offence under Sections 30(a)(b)(c), 34, 34, 36 of Bihar Prohibition and Excise Act.

30 liters of country-made liquor, two gas cylinder etc. have been recovered from the bank of river.

It is submitted on behalf of petitioner that nothing has been recovered from the conscious possession of the petitioner. Petitioner has got clean antecedent.

Considering the nature of allegation and clean antecedent of petitioner, let the above named petitioner, in the event of his arrest or surrender within a period of six weeks

Patna High Court CR. MISC. No.41799 of 2022(2) dt.30-09-2022 2/2 from the date of receipt / production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Exclusive Special Excise Court No. 1, Motihari, East Champaran in connection with Kotwa P.S. Case No. 7 of 2022, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
