JUSTICE DINESH KUMAR SINGH ORAL ORDER 28-09-2016 The petitioner being husband of the informant is languishing in custody since 23.04.2016 in a case registered for the offences punishable under Section 498A of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act.

The prosecution case is that the informant Madhu Kumari got married with the petitioner in July, 2013 but thereafter torture was inflicted for non-fulfilment of dowry demand of motorcycle. It is alleged that the petitioner used to assault the informant and made several attempts to kill her. The torture got increased after birth of a female child. It is submitted by learned counsel for the petitioner that accusation is omnibus and general and there is no injury report to suggest the accusation. Moreover the

Considering the nature of accusation and the investigation being concluded, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Patna in connection with Rajeev Nagar P.S. Case No. 83 of 2016.
