The petitioner, who is in custody since 06.09.2020, seeks bail in connection with Bhagwanpur P. S. Case No. 171 of 2020 dated 08.08.2020, instituted for offences under Section 30 (a) of Bihar Prohibition and Excise (Amendment) Act, 2018. It appears that 137.625 litres of liquor was recovered from behind the house of one Lakhindra Paswan and Sudhir Chaudhari.

The petitioner has been named by the aforesaid persons as one of the accused persons, who had stored

Patna High Court CR. MISC. No.37741 of 2020(2) dt.05-02-2021 2/2 the seized liquor.

There has not been any recovery from the possession of the petitioner and he does not have criminal antecedents.

Considering the nature of accusation and period of custody of the petitioner, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge - II - cum - Special Judge, Excise Act, Begusarai, in connection with Bhagwanpur P. S. Case No. 171 of 2020.

The petition stands allowed.
