The petitioner seeks regular bail in connection with Alinagar P.S. Case No.9 of 2018 dated 29.01.2018 corresponding to G.R. No.28 of 2018 for the offences punishable under Section(s) 328, 302, 120(B)/34 of the Indian Penal Code. Allegation of the prosecution is that the daughter of the informant was married to one Sadre Alam who is said to be having an affair with the present petitioner, who is the widowed sister-inlaw of the said Sadre Alam. It is further submitted that there used to be quarrels amongst the petitioner, the said Sadre Alam and the deceased and ultimately the petitioner and the said Sadre Alam conspired together and administered poison to the deceased resulting in her death.

No.27801 of 2018 (3) dt.21-05-2018 2/2 The learned counsel for the petitioner submits that if at all the poison could have been administered, it could have been done by her husband, Sadre Alam, but the petitioner does not have any role in the said occurrence. It is further submitted that till date nothing has come on record to show that poison was administrated to the deceased. The petitioner is said to languishing in custody since 31.01.2018 and is having a clean antecedent. Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (rupees Ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Benipur, Darbhanga in connection with Alinagar P.S. Case No.9 of 2018 dated 29.01.2018 corresponding to G.R. No.28 of 2018.
