JUSTICE SUDHIR SINGH ORAL ORDER 24-07-2015 The petitioner is apprehending his arrest in Mozahidpur P.S. Case No.68/15 for the offence under Sections 498(A) and 406/34 of the I.P.C.

Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The prosecution case, in brief, is that on 26.2.2009 the informant was married with the petitioner. After some time her sasural people started torturing her and demanded dowry. She has been blessed with a baby. On account of non-fulfillment of the same she was assaulted badly by them.

It has been submitted on behalf of the petitioner that he is ready to keep the complainant with full dignity and

He is ready to deposit an amount of Rs.1500/- per month in the court below which shall be released in favour of the complainant. On behalf of the State it has been submitted that the petitioner has been named in the F.I.R. who is husband of the complainant.

Considering the aforesaid facts and circumstances, petitioner is directed to deposit Rs.1500/- per month in the court below which shall be released in favour of the petitioner and on his doing so, let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of C.J.M., Bhagalpur, in Mozahidpur P.S.Case No.68 of 2015 subject to the conditions as laid down under Section 438(2) of Cr.P.C.
