1. Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel appearing on behalf of the opposite party no. 2.
2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 341, 323, 504 and 498(A) of the Indian Penal Code as well as Sections 3 and 4 of the Dowry Prohibition Act.
3. Learned counsel for the opposite party no. 2, at the outset, submits that he has instruction to make submission not to oppose the prayer for anticipatory bail of the petitioner.
4. Considering the submission made by the learned counsel appearing on behalf of the opposite party no. 2, the petitioner, above-named, in the event of his arrest or surrender
Patna High Court CR. MISC. No.43473 of 2023(5) dt.14-05-2024 2/2 before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.2,000/- (Rupees Two Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Tr. No. 3689 of 2022 arising out of Complaint Case No. 200 of 2021, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
5. Learned counsel for the opposite party no. 2, at this stage, submits that opposite party no. 2 will withdraw the instant criminal case against the petitioner.
