Informant who happens to be husband of victim, a major one had alleged that petitioner Sumit Giri, Upendra Narayan Giri, Geeta Devi, Shubham Giri, Soni Kumari, Moni Kumari, Sanjeet Kumari and his brother-in-law enticed away his wife Nitu Giri. From the statement recorded under Section 164 Cr.P.C. of the victim (Annexure-2), it is apparent that she had contradicted the allegation contrary to it, she had indicated her husband on account of having murderous attack upon her.

Considering the status of the victim to be major in consonance with period of detention since 08.11.2016, petitioner Sumit Giri is directed to be released on bail on furnishing bail bonds of Rs.10,000/-(ten thousand) with two sureties of the like amount each, to the satisfaction of learned Addl.
