JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 03-07-2018 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Mehandiganj P.S. Case No. 49 of 2016 for the offence under Sections 20 and 22 of the N.D.P.S. Act.
Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent. In the instant case, allegation is that 8.9 Kg. Ganja was seized. He submits that the petitioner on surrender was taken into custody on31.03.2018 and he has now completed three months.
Considering the fact that petitioner has no criminal antecedent and the investigation in the instant case is now complete, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the
Patna High Court Cr.Misc. No.27807 of 2018 (3) dt.03-07-2018 2/2 satisfaction of learned Sessions Judge, Patna in connection with Mehandiganj P.S. Case No. 49 of 2016 with the condition that in case the petitioner is found indulged in terrorizing the witnesses, the court below would be at liberty to cancel the bail bonds of the petitioner and in case the petitioner delays the trial, the court below is also directed to ensure presence of the petitioner in the trial and in case non-co-operation of the petitioner in the trial, the trial court may take appropriate steps, as required in the facts and circumstances of the case.
