The petitioner seeks bail in Ekangarsarai P.S. case No. 223 of 2015 under Section 457, 380 of the Indian Penal Code. The informant lodged the case against unknown for theft in his house. The informant alleged that ornaments, house hold articles etc. and cash worth Rs. 60,000/- were stolen. During the course of investigation, the petitioner was apprehended and he confessed his guilt but nothing has been recovered from the possession of the petitioner.
The petitioner is in jail since 13.07.2016. Save and except confession of the petitioner and other accused persons, there is no material against the petitioner. No stolen article was
Patna High Court Cr.Misc. No.39278 of 2016 (3) dt.22-11-2016 2/2 recovered from the possession of the petitioner nor the articles were put on test identification parade.
Considering the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Hilsa, Nalanda in Ekangarsarai P.S. Case No. 223 of 2015.
