The petitioner seeks regular bail in connection with Kateya P.S. Case No.240 of 2017 (GR No.3093 of 2017) for the offences punishable under Section(s) 461 & 379 of the Indian Penal Code. The allegation is regarding 65 idols and mobile phone being stolen from a temple.

The learned counsel for the petitioner submits that upon the confessional statement of petitioner, petitioner was arrested in one another case and thereafter, he was remanded in the present case. In fact there is no material on record to implicate the petitioner in the present case. It is further submitted that neither TI parade has taken place nor any recovery has been made from the petitioner. The petitioner is said to be languishing in custody since 07.03.2018.

No.28331 of 2018 (3) dt.30-05-2018 2/2 Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (rupees Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-XV, Gopalganj, in connection with Kateya P.S. Case No. 240 of 2017 (GR No.3093 of 2017).
