JUSTICE ARVIND SRIVASTAVA ORAL ORDER 08-02-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case initially registered under Section-307 & other minor sections of the Indian Penal Code and later on, Section-302 of the Indian Penal Code was added. The allegation against the petitioner is that he, along with others opened fire and allegedly, the petitioner's shot hit the left hand of the deceased.
It is submitted that the accusation against the petitioner is false and he has got no criminal antecedent. Learned Addl. Public Prosecutor opposed the prayer submitting that the petitioner opened fire which hit the left hand of the deceased.
Patna High Court Cr.Misc. No.48752 of 2016 (4) dt.08-02-2017 2/2 Taking into consideration the above-said facts and circumstances of the case as well as submission of the parties, I am not inclined to release the petitioner on bail and accordingly, his prayer for bail in connection with Danapur P.S. Case No. 621 of 2015 stands rejected.
However, the petitioner may renew his prayer for bail after framing of charge.
