JUSTICE SUDHIR SINGH ORAL ORDER 24-07-2015 Heard learned counsel for the petitioners as well as learned counsel for the State.

In this application for anticipatory bail the petitioners apprehend their arrest for the offences punishable under section 147, 341, 323, 337, 379, 325 and 504 of the I.P.C The prosecution story, in brief, is that when the informant was going to his Samadhi house with Rs. 30,000/- to give him the petitioners knowing it surrounded him in a lonely place and petitioner no.1 assaulted with lathi on the left hand which became fracture and accused Karu Yadav assaulted with a stone petting which hit on his head and the informant became senseless and the accused persons snatched Rs. 30,000/- from

Patna High Court Cr.Misc. No.28861 of 2015 (2) dt.24-07-2015 2/2 possession of the Informant.

It is submitted on behalf of the petitioners that from perusal of the FIR it would appear that the alleged date of occurrence is 27.03.2014 but the case was instituted on 11.04.2014 after delay of 15 days. It is further submitted that the petitioners have got no criminal antecedents.

On behalf of the State, it has been submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, the above named petitioners, in the event of their arrest or surrender in the court below within a period of four weeks, shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of. Sri N.P. Singh, J.M. 1st Class, Sherghati, Gaya in Barachatti P.S. Case No. 145 of 2014, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
