Petitioner is in custody since 08.08.2016 in connection with Nagar P.S. Case No. 112 of 2015 registered under Sections 302, 120B/34 of the Indian Penal Code and Section 27 of the Arms Act. Accusation is of murder caused by fire arms.
Learned counsel for the petitioner has submitted that the petitioner is innocent and has not committed any offence. In fact, initially the petitioner was not named in the F.I.R. but during course of investigation, informant has falsely implicated this petitioner merely on the ground of suspicion. There is no specific allegation against this petitioner. No any witness has supported the implication of the petitioner in the alleged occurrence. Moreover, co-accused, having more or less similar, allegations have already been granted anticipatory bail by a co-ordinate Bench of this Court in Cr. Misc. No. 4331 of
Patna High Court Cr.Misc. No.52848 of 2016 (3) dt.13-02-2017 2016.
Considering the facts and circumstances of the case and nature of accusation, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand rupees only) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Begusarai in connection with Begusarai (Town) P.S. Case No. 112 of 2015.
