JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 23-06-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Sultanganj P.S. Case No. 174 of 2010 registered for the offences punishable under Sections 341, 323, 324, 307, 379/34 of the Indian Penal Code.
The accusation against the petitioner is that he gave dagger blow twice on the neck of the informant but submission on behalf of the petitioner is that only one lacerated injury on the neck of the informant was found in course of medical examination and the aforesaid injury was found simple in nature. Learned counsel appearing for the petitioner submits that in course of investigation, the independent witnesses stated
Patna High Court Cr.Misc. No.2471 of 2015 (4) dt.23-06-2015 that on a petty issue, altercation took place between the parties and petitioner gave one Kalchu blow to the informant as a result of which informant sustained simple injury.
Regard being had to the facts and circumstances of the case as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Patna City, Patna in Sultanganj P.S. Case No. 174 of 2010 subject to condition as laid down under Section 438(2) of the Cr.P.C.
