JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 23-06-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with Jehanabad Mahila P.S. Case No. 54 of 2013 registered for the offence under Sections-323, 498(A) & 304(B) of the Indian Penal Code.

The petitioner happens to be husband of the deceased and it is admitted position that the marriage of the deceased had taken place with the petitioner in the year, 2005 whereas; the deceased died in the month of October, 2012. Furthermore, the informant has admitted that he got information about the death of deceased and thereafter, went to Bansh Ghat

Patna High Court Cr.Misc. No.3368 of 2015 (6) dt.23-06-2015 2/2 where the cremation of dead body of the deceased was performed. Learned counsel, appearing for the petitioner drew my attention towards Annexure-2 series to this petition and submits that as a matter of fact, the deceased died of her ailment at PMCH, Patna and after her death, a certificate was issued which reveals that the cause of death was puerperal sepsis. Considering the aforesaid facts and circumstances of the case as well as submission of the parties, let the petitioner named above, in the event of his arrest or surrender within four weeks from the date of receipt/production of copy of the order in the court below, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Jehanabad Mahila P.S. Case No. 54 of 2013 to the satisfaction of Learned Chief Judicial Magistrate, Jehanabad subject to conditions as laid down u/S 438(2) of the Code of Criminal Procedure.
