2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 304(B)/34 of the Indian Penal Code.
3. As per the prosecution case, wife of petitioner was pregnant and the petitioner brought the wife of informant to his hospital and took Rs. 20,000/- to operate his wife. It is further alleged that wife of the informant gave birth to a child and thereafter, she died.
4. It is submitted that petitioner has been falsely implicated in this case. Petitioner has not operated the wife of informant which is apparent from the FIR itself. It was Dr. Ghanshyam Singh who operated the wife of informant.
Patna High Court CR. MISC. No.41210 of 2023(3) dt.29-08-2023 2/2 Petitioner is only alleged to be the owner of the said nursing home where the operation took place. Petitioner is nowhere involved in the operation or treatment of the wife of informant. Petitioner claims clean antecedent.

Considering the facts aforesaid, the petitioner above-named, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Sherghati, Gaya in connection with Imamganj P.S. Case No. 49 of 2023, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
