JUSTICE ARUN KUMAR ORAL ORDER 18-07-2018 Heard learned Counsel for the petitioner and the State as also the learned Counsel appearing on behalf of the informant. Petitioner, already in custody since 14.3.2018, seeks bail in Naubatpur PS Case No. 438 of 2017 registered under Sections 302 and 120B/34 of the IPC.
The allegation in brief is that the deceased had deposed in a criminal case in which the petitioner and others were accused, earlier they used to give pressure to compromise the case, asking him not to depose and threatened in that connection and suspicion is raised that deceased was killed by the accused persons.
Learned Counsel for the petitioner submits that suspicion is raised against the petitioner on account of enmity, however there is no eye witness in the case.
Whereas learned Counsel for the informant submits that one criminal antecedent has been suppressed by the petitioner; the prayer for bail of two similarly situated co-accused namely Ranjit Kumar and Amarjeet Mahto was earlier rejected by this Court with an observation that they may renew the prayer for bail after six months since framing of the charge.
Patna High Court Cr.Misc. No.29238 of 2018 (5) dt.18-07-2018 Having considered the said facts and circumstances, the prayer for bail of the petitioner is rejected. However, the petitioner if so advised may renew his prayer for bail after six months since framing of the charge.
