2. The petitioner apprehends their arrest in a case registered for the offence under Sections 420, 467, 468, 471/34 of the Indian Penal Code .
3 . As per the prosecution case, this petitioner along with co-accused namely Kanhaiya Kumar sold the land in question to other co-accused persons by creating forged and fabricated documents.
4. Learned counsel for the petitioners submits that
Patna High Court CR. MISC. No.46137 of 2025(3) dt.18-08-2025 2/3 Khatiyani of the land in question reflects that the same which was in the name of Khado Gope for which sale deeed vide Deed No. 4756 of 1925 was executed by Jamna Gope , son of Khado Gope to Babu Mahavir Singh and petitioner being legal heir of Babu Mahavir Singh, executed the sale deed in question . He further submits that informant is no having any chit of paper to substantiate the case and rather he is willing to acquire land by forged and fabricated papers. Moreover, dispute involved in this case is with regard to sale and purchase of land which is purely civil in nature . Petitioner claims clean antecedent. Similarly situated co-accused persons have already granted bail by this Court vide order dated 29.07.2025 in Cr. Misc. No. 35627 of 2025 .
5. However, learned counsel for the informant vehemently opposes the bail petition .
6. Considering aforesaid facts and circumstances and the fact that dispute is purely of civil nature, the prayer for anticipatory bail is allowed. Let the above named petitioner, in the event of their arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate,
