JUSTICE BIRENDRA KUMAR ORAL ORDER 13-02-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Section 414 of the Indian Penal Code and Section 25(1-b)A/26/35 of the Arms Act and Sections 53(c)/54 of the Bihar Excise (Amendment) Act, 2016. One country-made loaded pistol was recovered from the possession of this petitioner. Recovery of liquor is from co-accused Deepak Kumar, who has already been allowed regular bail by a coordinate Bench of this Court in Cr. Misc. No.32384 of 2016 on 17.09.2016. The petitioner is in custody since 27.04.2016.
Considering the period already undergone by the
Patna High Court Cr.Misc. No.53734 of 2016 (4) dt.13-02-2017 2/2 petitioner, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of Mr. Rahul Kishore, learned Judicial Magistrate, 1st Class, Begusarai/Successor Court, in connection with Begusarai Town P.S. Case No. 204 of 2016. One of the bailors shall be local resident having immovable property.
