The petitioner apprehends his arrest in a case under Section 498A of the Indian Penal Code and Section 4 of Dowry Prohibition Act.

The allegation against the petitioner is that he subjected her wife with different sorts of torture due to nonfulfillment of demand of dowry. The petitioner was granted anticipatory bail by the learned Sessions Judge vide order dated 17.01.2015 in A. B. P. No. 2231 of 2014 but the compromise could not be arrived at between the husband and wife. The husband filed Misc. case No.

Patna High Court Cr.Misc. No.29487 of 2015 (2) dt.27-07-2015 2/2 13 of 2015 for modifying the condition imposed in the earlier order dated 17.01.2015 passed in A. B. P. No. 2231 of 2014 as his wife has taken tough stand and the matter could not be resolved. Considering the fact that petitioner was earlier granted anticipatory bail on the submission that the husband and wife were ready to compromise the case but for one reason or the other the husband and wife could not be able to resolve their dispute, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
