03-11-2015 Heard Sri Ram Naresh Ray, learned counsel for the petitioner and Sri Sunil Kumar Mandal, learned Standing Counsel - 24.

The petitioner in the present writ petition has prayed for directing the respondents to pay arrear of salary for the period from 01-07-2006 to 31-12-2006 with interest.

In this case, a counter affidavit has been filed on behalf of respondent no. 3.

Sri Mandal, learned State counsel, by way of referring

Patna High Court CWJC No.3748 of 2011 (3) dt.03-11-2015 2/2 to paragraph - 6 of the counter affidavit, submits that the claimed arrear of salary has already been paid to the petitioner, vide cheque dated 24-08-2012.

Learned counsel for the petitioner does not dispute the fact, however; he submits that interest has not been paid on delayed payment.

It is admitted fact that the petitioner is still continuing in service and as such, the petitioner may not claim interest on the salary, which was admitted and has already been paid. The writ petition, keeping in view the fact that relief has already been granted, stands disposed of. (Rakesh Kumar, J.) Anay U
