JUSTICE BIRENDRA KUMAR ORAL ORDER 19-06-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 25(1-B)a/26/35 of the Arms Act.

Allegation against the petitioner is that a country made loaded pistol and two cartridges were recovered from his possession on 23.11.2016.

Similarly situated co-accused Jangli Sah has been allowed bail by this Court in Cr. Misc. No.22219 of 2017 on 09.05.2017.

Considering the aforesaid facts, let petitioner, above named, be enlarged on bail on furnishing bail bond of

Patna High Court Cr.Misc. No.20644 of 2017 (3) dt.19-06-2017 2/2 Rs.20,000/-(Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur/Successor Court, in connection with Kotwali (Adampur) P.S. Case No.648 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
