JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 06-07-2018 Heard the learned counsel for the petitioner and State. The petitioner is in custody in connection with Sasaram (M) P.S. Case No. 155 of 2018 for the offence under Sections 30(a), 35, 38 of the Excise Act.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he has in custody since 02.04.2018. Learned counsel for the petitioner submits that in the instant case there is no requirement of mandatory provision of Section 100 Cr.P.C., he submits that in the instant case now the investigation is complete and as such the petitioner deserves bail as he has no criminal antecedent. Considering the fact that the petitioner has remained in custody for more than two months and he has no criminal
