2. The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Chainpur P.S. Case No. 209 of 2025 instituted for the offence under Sections 140(3), 308(5) and 3(5) of the B.N.S.

3. The case of the prosecution is that one Santosh Kharwar has disclosed that this petitioner along with others has called him for receiving articles of the auction.

4. Learned counsel for the petitioner has submitted that the name of this petitioner has surfaced in the last line of the FIR only on the basis of the statement of the co-accused Santosh Kharwar. It has also been submitted by the learned counsel that one co-accused having similar nature of allegation namely,

Patna High Court CR. MISC. No.40421 of 2025(2) dt.25-07-2025 2/2 Vikash Kumar Dubey has been granted bail vide Cr.Misc. Case No. 38042 of 2025 by this Court. The case of this petitioner stands on similar footing.

5. Learned APP for the State has vehemently opposed the prayer for bail to the petitioner.

6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Chainpur P.S. Case No. 209 of 2025, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabhua, subject to the conditions as laid down under section 482(2) of the BNSS.

7. Accordingly, the present bail application stands allowed.
