29-09-2016 Heard Sri Sunil Kumar, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 29-07-2016 in Patna Junction Rail P.S. Case No. 196 of 2016 registered for offence under Section 273 of the Indian Penal Code and Section 47(a) of Bihar Excise Act, 2016, has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that petitioner is having clean antecedent and this fact has been stated in paragraph - 3 of the petition. Learned counsel for the petitioner submits that on false accusation of recovery of about seven litres of foreign liquor, the petitioner was arrested at railway station and he is in custody since then.

No.40864 of 2016 (2) dt.29-09-2016 2/2 Keeping in view the nature of accusation, clean antecedent of the petitioner and period of custody, let the petitioner namely Suman Kumar Nirala be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Sanjay Kumar Singh, Railway Judicial Magistrate, Patna Junction in connection with Patna Junction Rail P.S.
