Mr.Atul Chandra ====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 06-09-2024 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State.

2. The petitioner is seeking regular bail in connection with Athamalgola P.S. Case No. 09 of 2019 for the offences punishable under Sections 147, 148, 149, 323, 307, 447 of the IPC and Section 27 of the Arms Act.

3. The specific allegation against the petitioner is of firing on the leg of the informant.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. She has further submitted that the petitioner is under custody since 17.01.2024. She has also submitted that a number of civil and criminal cases are pending between the parties.

5. On the other hand, the learned APP for the State

Patna High Court CR. MISC. No.46841 of 2024(3) dt.06-09-2024 2/2 has opposed the prayer for bail.

6. It appears that the nature of injury is still awaited.

7. Considering the above-mentioned facts and circumstances as well as the period of incarceration and also considering the fact that there are cases between the parties relating to land dispute, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand rupees) with two sureties of the like amount each to the satisfaction of learned SDJM, Barh, Patna in connection with Athamalgola P.S. Case No. 09 of 2019, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
