Petitioner apprehends his arrest in connection with Chand P.S. Case No. 17 of 2015 registered for the offence under Sections-406, 409, 420 of the Indian Penal Code. Petitioner happens to be rice miller and disputes the quantity of supply of paddy, given in the first information report and it has, specifically, been pleaded at paragraph-14 of the petition that he lifted only 1650/- quintals of paddy and only deposited 270 quintals of CMR to the godown of SFC. It is pointed out that certificate case has also been filed against the petitioner.
Considering the aforesaid facts and circumstances as well as submission of the parties, let the petitioner named
Patna High Court Cr.Misc. No.30315 of 2015 (2) dt.31-07-2015 2/2 above, in the event of his arrest or surrender within four weeks from the date of receipt/production of copy of order in the court below, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Chand P.S. Case No. 17 of 2015 to the satisfaction of Shri A. K. Singh, learned Judicial Magistrate-Ist Class, Kaimur at Bhabua subject to conditions as laid down u/S 438(2) of the Cr. P.C.
