08-05-2018 Heard Sri Subodh Kumar, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, having clean antecedent, which fact has been stated in paragraph - 3 of the petition, has prayed for grant of bail in Kanhauli P.S. Case No. 34/2018 registered for offence under Sections 272, 273 of the Indian Penal Code and Sections 30(A), 41 of Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that on false accusation of recovery of about 30 liters of Nepal Saufi wine, the petitioner was apprehended and he is in custody. It has also been argued that seizure list was not prepared in accordance with law.

Considering the nature of accusation and clean

Patna High Court Cr.Misc. No.24308 of 2018(3) dt.08-05-2018 2/2 antecedent, let the petitioner namely Sanjay Kapar be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge II cum Special Judge Excise, Sitamarhi in connection with Kanhauli P.S. Case No. 34/2018.
