The petitioner is accused in connection with Bhabua P.S. Case No. 73 of 2019 registered under section 363 of the I.P.C. pending in the Court of C.J.M., Bhabua at Kaimur. Later on, section 364(A) of the I.P.C. was added. Submission of learned counsel for the petitioner is that petitioner is in custody since 02.03.2019. He is innocent and has falsely been implicated in the present case. Further submission is that petitioner has no concern with the seized mobile.

Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioner by contending that

Patna High Court CR. MISC. No.36860 of 2019(3) dt.11-09-2019 2/2 petitioner has criminal antecedent. In course of investigation, the name of the petitioner has been transpired in the present case. Further submission is that body of the kidnapped boy has not yet been recovered.

Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to allow the prayer of the petitioner for bail. Accordingly, this application is rejected.
