The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Baikunthpur P.S. Case no. 164 of 2019 instituted for the offence under Sections 392 of the Indian Penal Code. The accusation is of snatching the bag of informant, containg Rs. 1,17,080/- alongwith POS machine, Bluetooth and other materials by motorcycle borne miscreants while he was returning was returning to the bank.

Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. Neither the petitioner is named in F.I.R. nor anything incriminating has been recovered from his conscious possession.

Patna High Court CR. MISC. No.42837 of 2024(2) dt.20-06-2024 2/2 He has not been put on T.I.P. The name of the petitioner has been disclosed in this case by the apprehended co-accused persons, namely, Manoj Kumar and Subodh Kumar. Petitioner was not apprehended on the spot.

Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Baikunthpur P.S. Case no. 164 of 2019, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Gopalganjsubject to the conditions as laid down under section 438(2) of the Cr.P.C.
