The petitioner seeks bail in a case registered under Sections 457, 380, 511, 427 of the Indian Penal Code. Allegation is that some unknown persons attempted to commit theft of cash amount from A.T.M. by using cutting gas cuter, due to which Rs.6700/- damaged.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 1.1.2019. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. His name has come merely on the basis of suspicion. No stolen property is alleged to have been recovered. On behalf of the State, it is submitted that the

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. XII, Bhagalpur in connection with Habibpur P.S. case No.180 of 2018.
