JUSTICE DINESH KUMAR SINGH ORAL ORDER 15-04-2015 Heard learned counsels for the petitioner and the State. The petitioner being the husband of the victim is apprehending arrest in a case registered for the offences punishable under Sections 304B/34 of the Indian Penal Code. The accusation is of killing the daughter of the informant for non-fulfillment of the dowry demand. It is submitted by learned counsel for the petitioner that as per own admission of the informant to the effect that the marriage was performed ten years prior to the occurrence, the case does not come within the purview of Section 304B of the IPC. Statement of the son of the victim has been recorded in paragraph 6 of the case diary which reflects that the victim committed suicide.

Patna High Court Cr.Misc. No.504 of 2015 (6) dt.15-04-2015 regular bail of the petitioner if he surrenders within a period of six weeks in connection with Nimchak Bathani P.S. Case No. 84 of 2014 pending in the court of learned CJM, Gaya. Accordingly, the application is disposed of.
