The petitioner is accused in connection with Raj Nagar P.S. Case No. 234 of 2015 registered under Sections 363 and 366/34 of the Indian Penal Code.
The allegation of informant is of kidnapping of his wife and three children by one Md. Faruk with the help of this petitioner.
Learned counsel appearing on behalf of the petitioner submits that the wife of the informant has not disclosed the name of the petitioner in her statement recorded under section 161 Cr.P.C. as she stated that she left her matrimonial house for
Patna High Court Cr.Misc. No.23177 of 2017 (2) dt.18-05-2017 2/2 Maika. But she disclosed in her statement recorded under section 164 Cr.P.C. that she was taken by Md. Faruk boarding on train then this petitioner asked her to perform the marriage with him but she did not make complaint about ill treatment at the hand of the petitioner. The petitioner having no criminal antecedent, is in custody since 04.01.2017.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri S.B.Kumar, Judicial Magistrate 1st class, Madhubani in connection with Raj Nagar P.S. Case No. 234 of 2015, subject to the condition that out of two sureties, one surety must be the close relative of the petitioner. (Rajendra Kumar Mishra, J) Mahesh/- U T
