2. This appeal has been filed by the plaintiff-appellant against the judgment and decree of reversal. The suit was filed by the plaintiff who was a tenant over the suit premises for grant of permanent injunction against the landlord-defendant evicting him from suit premises.
3. The learned senior counsel appearing for the appellant has fairly submitted that the lease though unregistered was only for 11 months. According to the case of the plaintiffappellant the said 11 months has already expired. A suit for eviction has been filed by the landlord-defendant against the
Patna High Court SA No.404 of 2013 (3) dt.31-03-2016 plaintiff-appellant seeking eviction from the suit premises and the matter is pending before this Court in revision under Section 14(8) of the B.B.C Act.
4. In view of the aforesaid submissions as the suit was for grant of permanent injunction and admittedly the lease was only for 11 months, which has already expired, this second appeal has now become infructuous, and is dismissed as such. (V. Nath, J) Ranjan/- U
