The petitioner apprehends his arrest in Sitamarhi P.S. Case No. 638/2014, registered for the offences punishable under Section 498A, 304B, 201, 366 and 34 of the Indian Penal Code. The petitioner is the husband. The informant alleged that his daughter is missing from the house of the petitioner and he got apprehension that petitioner might have killed his daughter and concealed her.
Learned counsel for the petitioner submits that wife of the petitioner fled away along with her brother-in-law, and for that the father of the petitioner filed a complaint case on which a FIR is lodged.
It appears that the wife of the petitioner was residing in
Patna High Court Cr.Misc. No.28866 of 2015 (3) dt.12-10-2015 2/2 the house of the petitioner and she also gave birth to a child, but thereafter, she is traceless from the house of the petitioner. Considering the facts aforesaid and the fact that petitioner is the husband, I am not inclined to enlarge the petitioner on anticipatory bail and accordingly the same is rejected.
