Petitioner seeks bail in a case registered under section 392 of the Indian Penal Code.

Petitioner is not named in the first information report nor anything has been recovered from his conscious possession. It appears that except confessional statement and criminal antecedent, there is nothing against him. However, it is worth to mention here that the petitioner was put on test identification parade but in spite of that informant as well as other witnesses failed to identify him. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, West Champaran at Bettiah in Gaunaha P.S.
