The petitioner seeks bail in connection with Bachhwara P.S. Case No. 72 of 2016, dated 17.05.2016, registered under Sections 147, 149, 447, 504, 427, 323 and 307 of the Indian Penal Code.
It is submitted and is also apparent from the records of this case that there is a case and a counter-case. One of the accused persons appears to have filed a counter-case wherein the date of occurrence appears to be the same. It is also submitted that the petitioner has no criminal antecedent and similarly situated coaccused, against whom the allegations are same and similar, has been granted bail by a co-ordinate Bench of this Court vide order
Patna High Court Cr.Misc. No.23885 of 2017 (2) dt.22-05-2017 2/2 dated 02.05.2017 passed in Cr. Misc. No.12511 of 2017. This position is not disputed by the learned counsel for the State.
Having regard to the facts and circumstances, as stated above, and in view of the fact that a similarly situated co-accused person has been granted bail, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. VI, Begusarai in connection with Bachhawara P.S. Case No. 72 of 2016 (Mohit Kumar Shah, J) BTiwary/- U T
