Having regard to the fact that the petitioner is aggrieved by his continued suspension as contained in the order dated 25.03.2013, this Court taking into account the averment made by the petitioner that such suspension is in absence of any criminal charge against the petitioner would be only by way of pending departmental proceeding and that the petitioner has already filed representation before the competent authority namely the Block Development Officer cum

Patna High Court CWJC No.12590 of 2015 (2) dt.17-08-2015 Member Secretary for withdrawing the order of suspension, this Court would deem it expedient in the ends of justice to direct respondent no. 5, the Block Development Officer, Katoriya, Banka, to take a final decision as with regard to continuation of suspension of the petitioner within a period of three months from the date of receipt of this order.

With the aforementioned observation and direction, this application is disposed of.
